Tool Guidelines and Waiver

This is the information included on the waiver you will be asked to sign when borrowing a tool from the ROPL. 

 

 

Library of Things Guidelines and Liability Waiver

1. Borrowers must be at least 18 years old to check out any Library of Things item.

2. Borrowers must have a valid Red Oak Public library card with a verified permanent address to check out any Library of Things item for use outside the library.

3. Items check out for one (1) week and may be renewed up to two (2) times if there are no holds on the item. If items are returned late, a late fee of $5/day applies. Items will go to lost status after 6 days and the full cost of the item will be assessed to your account until the item is either returned or paid for.

4. While staff can provide a basic overview of items in the collection, by taking possession of any item, the borrower is certifying that they are capable of using the item in a safe and appropriate manner. Borrower is the only authorized user of the item and is solely responsible for all liability for such use.

5. Library of Things items must be returned during the open hours to the Circulation Desk at the Red Oak Public Library. Items may not be returned in any outdoor book return.

6. The borrower agrees that if any item becomes unsafe or in a state of disrepair, they will immediately discontinue use of the item and notify the Library of the issue on return, if not earlier. Items are borrowed as-is, and while the Library will make efforts to determine that items are in good condition prior to checkout, it cannot be guaranteed.

7. Items intended for use with food or drinks cannot be guaranteed to be free from allergens or cross contamination.

8. All uses of Library of Things items must comply with all applicable laws, including copyright law.

9. The borrower acknowledges that they have made an inspection of the item they are borrowing and are accepting the item in its condition.

10. All Library of Things are to be returned in the same condition as they were issued, barring normal wear and tear. The borrower agrees to pay for the loss of or damage to any item, up to and including the full retail price of the item if deemed necessary.

11. Items must be returned clean. If not returned cleaned, a cleaning fee of $20.00 shall be assessed.

My signature below indicates that I have read the following statements and that I agree to abide by these conditions of use when checking out Things from the Library of Things Collection:

A. I agree to accept full responsibility for the Thing while it is checked out to me.

B. I agree to pay all costs (including full replacement cost) associated with damage to, loss of, or theft of the material and accessories while it is checked out to me.

C. I agree to the loan period set for the Thing borrowed and I agree to return the Thing to a staff member inside the Library (not in the drop box).

Liability Waiver

In consideration of my use of the Thing lent by the Red Oak Public Library, I hereby voluntarily release, discharge, waive, and hold harmless the Red Oak Public Library and its employees, the Board of Trustees, and the City of Red Oak, Iowa and its employees from any loss, damage, or injury to persons or property arising from the Thing. In no event shall the Library be liable to me for indirect or consequential damages.

I agree to indemnify and hold the Library and its employees harmless from and against any liabilities, claims, actions, proceedings, damages, losses, costs, and expenses, including attorney’s fees, for all injuries or death of any person, or damage to any property occurring or connected with, directly or indirectly, my possession, use, and return of the equipment.

I am borrowing the Thing as-is. I acknowledge that I have examined the Thing and that its condition is acceptable. I agree to keep and maintain the Thing in good condition, use it in a careful and appropriate manner, and to comply with all manufacturer recommendations.

I understand that the Library does not provide supervision or instruction for use of the Thing. I understand and acknowledge that the use of the Thing may involve a risk of serious injury. I agree to refrain from using the Thing in a manner inconsistent with its intended purpose.
